General Conditions

The RENT-A-CAR AUTO TURÍSTICA PICOENSE hereby rents this document rents a car to the client that signs it in page 1 the descript vehicle with the following conditions:

1. Renter will return the vehicle together with all tires, tools, car documents, accessories and equipment.

2. Renter received the vehicle in good order, condition and has acknowledge liability for the cost of fuel consumed during the rental period.

3. The vehicle should not be operated:

a) To transport goods in violation of customs or in any other illegal manner.
b) To transport passengers or property in exchange of express or implied remuneration.
c) To propel or tow any vehicle or trailer.
d) In motor sports events.
e) By any person under the influence of alcohol or drugs. Further, the vehicle will be operated only by the renter with a minimum age of 23 years old, possessing a valid driver’s license for over one year and the duly qualified through a previous and expressed authorization of RENT-A-CAR AUTO TURÍSTICA PICOENSE.

4. That renter expressly acknowledges personal liability to pay to RENT-A-CAR AUTO TURÍSTICA PICOENSE on demand:

a) A kilometer charge computed at the rate specified for the kilometers covered by the vehicle during the terms of the rental.
b) Time, collision damage waiver (CDW), personal accident insurance (PAI) and miscellaneous charges at the rates specified on the page 1 of the rental contract.
c) All taxes based on a) and b).
d) All fines and judicial expenses, costs of parking, traffic or other violations of law assessed against the vehicle, renter or RENT-A-CAR AUTO TURÍSTICA PICOENSE during the term of this rental contract except where caused through fault of RENT-A-CAR AUTO TURÍSTICA PICOENSE.
e) All judicial and attorneys fees resulting from faulty payments from renters to RENT-A-CAR AUTO TURÍSTICA PICOENSE.
f) The cost of repair the damages caused by crash, collision or upsetting of the vehicle not exceeding the maximum damage liability equivalent to the total value of the vehicle as specified in the current rate brochure. This liability is for each and every vehicle include in the same rent contract.
g) The liability shall be reduced to the payment of the non waivable excess charge if the rentrer has previously purchased the colision damage waiver (CDW) by means of his signature or initials in the respective “CDW yes” space on page 1 of the contract.

5. Super CDW:

a) By purchasing super CDW in addition to TP insurance clients liability in case of accident is reduced to a minimum obligatory deductable as per rate.
b) Renters responsibility is for all damage and losses caused to vehicle and RENT-A-CAR AUTO TURÍSTICA PICOENSE when renter violates any condition of this contract.
c) All fees resulting from loss, or of documents danification, tools or accessories of the vehicle.

6. That renter and any authorized operator, as prescribed in paragraph 3 preceding participants as an insurer under an automobile insure policy copy of which will be available for inspection by renter at the RENT-A-CAR AUTO TURÍSTICA PICOENSE office. Said policy contains unlimited coverage against third party liability. Renter is bound by and agrees to the terms and conditions thereof. It is understood by the renter that said policy does not insure renter’s liability by reason of death or bodily injury sustained by renter, nor renter’s liability by reason of death or bodily injury sustained by renter, nor renter’s liability unders the law. Renters agrees further to protect the interest of RENT-A-CAR AUTO TURÍSTICA PICOENSE and RENT-A-CAR AUTO TURÍSTICA PICOENSE insurance company in case of accident during the term of the rental by:

a) Obtaining names and addresses of the people involved and of witnesses.
b) Not admitting liability or guilty.
c) Not abandoning the vehicle without adequate provisions for safeguarding and securing.
d) Calling RENT-A-CAR AUTO TURÍSTICA PICOENSE, giving a detailed report, including diagram.
e) Notifying the police immediately if party’s guilt has to be ascertained or if people are injured.

7. The renter accepts the terms and conditions of the personal accident insurance (PAI), arranged by the RENT-A-CAR AUTO TURÍSTICA PICOENSE with his insurance company for the account of its client and shall purchased same by signing to initializing the space provide in the page 1 in the box “pai yes”. He shall obtain cover for death or permanent disability and medical expenses for the persons travelling in the vehicle according to the terms and conditions of the insurance policy obtainable at RENT-A-CAR AUTO TURÍSTICA PICOENSE office.

8. Renter hereby releases RENT-A-CAR AUTO TURÍSTICA PICOENSE of and from any liability for loss or damage to any property left, stored or transported by renter or any other person in or upon the vehicle even after it is returned. Renter further agrees to release M&F of and from any liability regarding complains and fees derving from damages or loss.

9. The RENT-A-CAR AUTO TURÍSTICA PICOENSE may not trigger the SUPER CW insurance, CDW, TP and that always occuring situations of serious intent or gross negligence, such as:

Alcohol and Narcotic Drugs;
Exceeding the speed limit;
Overtaking when forbiten;
Infringement of Stop signal;
Out of road;
Damages under the car;
Rim or tire destroid;
Acts of vandalism.

10. RENT-A-CAR AUTO TURÍSTICA PICOENSE whilst taking all precautions and using his best efforts to prevent such happening shall should not be liable for mechanical failure of the vehicle or consequential damages. When not in use, renter shall always locks the vehicle.

11. Additions or alterations of the terms and conditions of this agreement shall be null and void unless agree upon in writing.

12. This contracts is construed in accordance with the laws of the country where this agreement is signed and that both parties agree to submit to the courts of Portuguese Republic.
